View Full Version : very important need help/opinions

im going through some major issues at the moment with work, and wondering if i have a case or not.

as some of you may know, last monday i was injured on the job. while at work i was passing buckets of cement up 3 levels of scaffolding when the new worker atour job threw an empty bucket down off of the top level to me instead of dropping it, forcing it to land on top of me. when i went to shield my head, the bottom of the bucket spun down, and clipped the front of my hair line instantly splitting my head open. upon going to the hospital i recieved 4 stitches and was diagnosed with a mild to severe concussion, and recieved orders to stay home untill the stitches were removed. (my boss was forced to pay for this injury). upon leaving the hospital i called my boss, during this conversation he said literally nothing, told me he would cqall me later and hung up on me. 4 days passed with a telephone call so i called him back, where he again ignored me and hung up. me stitches were removed monday ((1 week later) and i was told there was no jobs for me on tuesday, wednesday, and when i called him today he told my brother to come in who i work with, and not me. it is possible that he is firing me but will not directly say it to me.
thats the story and here is a little info about my work.
the company is Paul's Cement. a private contractor with full licences, and been a business for about 70 years. very legit,, very prestigious company.

now with that said, if i was to take this man to court, would i have a case? i am willing to call my lawyer and go th full route with this if possible, however do ot want to waste my time. any help or info would be greatly appreciated as i know there is a very inteligent group of people here :) thanks in advance

It depends on a couple of things, I would assume. Were you under a contract, or simply on a day-to-day basis? He's paid for the treatment of your injury, and unless there's anything more to it (seeing how you got your head hit pretty bad you could get problems with concentration, headaches, that sort of thing) I don't think there's anything more you could expect. I would read through your contract first and see what rights you have, regarding him keeping you employed or not.

unfortunately I think you are going to need to actually ask your lawyer and explain the situation. You will need to have heard from the boss he is going to 'fire' you officially for a really solid case, I think.

no there is no contract, i guess you could say a day to day job, been with them 8 months missed only 2-3 days before this and thats working 6 days a week

Well, on what grounds do you plan to sue them exactly? For being mean?

Like Rip had said. Talk to a lawyer about the whole legal situation. He can give you far more information then this board can. No offense to anyone of course.

Should at least be eligable for workers comp as the work related injury caused your not getting assignments

Ya... if you were under no form of contract, then I'd say that you don't really have a case against him. He didn't fight paying for the hospital visit. Sure, he's being an a-hole, and is completely disrespecting you in the process, but I doubt you could actually form a case out of it.
